Howard Gutman graduated from Drew University, cum laude, and the University of Michigan Law School, which has been ranked as one of the top law schools in the country. At Michigan, he served as an editor of the Journal of Law Reform and then went on to serve a clerkship at Haight, Gardner, Poor & Havens, a firm of approximately 100 lawyers specializing in international law. After graduation, he went on to handle commercial litigation at Hellring, Lindeman, Goldstein & Siegal and Hannoch Weisman, medium and large firms in New Jersey.

He then established a practice focusing on representing consumers and has been practicing in this area for over 25 years. He has tried over 50 cases with 10 published opinions in consumer cases. Several of his cases have appeared in national media and he has spoken at the National Press Club.
